You’ve had an accident with your snowmobile or ATV. Whether or not you were liable for the accident, it’s your insurer who indemnifies you. Be careful however! The compensation you receive will depend on your policy coverage. Your liability in the accident will also be a factor in establishing the compensation.

Degree of liability

Your insurer always assesses your degree of liability. He does that to establish the compensation to which you’ll be entitled. Are you 0%, 50% or 100% liable? He’ll establish your liability using a document entitled Direct Compensation Agreement or based on the facts reported to him.

Five-step process

The indemnity paid out for damages to your vehicle depends on your liability and the coverage you chose.

Were you at fault for the accident? You will be compensated if you purchased Collision coverage under Section B of your policy. Your insurer will deduct the amount of the policy deductible from the compensation. If you only purchased civil liability coverage (Section A of your policy), you will receive no compensation.
You weren’t at fault for the accident? You’ll be compensated even if you didn’t purchase Collision coverage. And you won’t have to pay the policy deductible.

Call your insurer or broker as soon as possible. Send him a copy of the duly completed Joint Report or the police report number.

Depending on the agreement, your insurer may indemnify you or reimburse the garage directly.
